  • believe that innovation is hindered, not helped, by software patents;
  • believe that the current clause 10A(2) of the Patents Bill undermines the exclusion of software patents;
  • request that Commerce Minister Craig Foss alter the Supplementary Order Paper for the Patents Bill currently awaiting its second reading before NZ Parliament to read as follows:
    10A(2): Subsection (1) does not prevent an invention that makes use of an embedded computer program from being patentable.

As developers of Marshal Software we are fully aware of the value of software IP and the pitfalls and potential barriers and costs to New Zealand developers of software patents. Except in extremely restricted fields such patents create far more harm than good for both the consumer and the industry. I absolutely oppose the creation of an artificial monopoly and rent collection industry in this area which can and will stifle innovation and competition.

38 Albert van Aardt Northland Polytechnic Computer software programs are essentially mathematical algorithms, i.e. methods to solve problems. If software were to be patented, then any thought process can be patented - an absurd situation. The laws around copyright are more than sufficient to protect the I.P. around software. Making software patentable will just over-complicate matters and stifle innovation, as new inventions will be tied down by endless court cases.
